COLLECTION AND COOKIES
We collect, process and retain personal information from you and any devices you may use when you navigate to a NEM web or mobile view, by transacting, by registering an account and otherwise interacting with us.

SHOPKIT AND PAYMENT PROVIDERS
Our online store is hosted with Shopkit.com Inc. They provide us with an online e-commerce platform that allows us to sell our products and services. A user’s data is stored through Shopify's data storage, databases and the general Shopify application. They store the data on a secure server behind a firewall.
Payment: if a user chooses a direct payment gateway to complete an order, then Paypal inc./ Stripe inc. (both Shopify Inc. partner) or EuPago stores the credit or debit card data. It is encrypted through the Payment Card Industry Data Security Standard (PCI-DSS). The order transaction data is stored only as long as necessary to complete an order transaction. After completing a transaction, the order transaction information is deleted. The below Terms and Conditions in NEMMADE.COM apply to all products acquired through it. Please carefully read the below information before you proceed to any payment, as in doing so you agree with the below-mentioned Terms and Conditions.

NEM is a protected trademark at the INPI and http://www.nemmade.com is also a protected domain name. No one is allowed to reproduce, use or distribute for any purpose whatsoever, even partially, elements of the site, unless the written agreement of NEM.
WEBSITE USAGE AND INFORMATION
The website is accessible 7 days a week, 24 hours a day, subject to any interruption, planned or not, for technical maintenance and/or security reasons or cases of circumstances outside of its control, as such we are not liable for any damage incurred by its unavailability.
NEM does not make any promises about the availability or accessibility of the website or guarantee that the access to the website, the content on it or the services it provides will be delivered uninterrupted, timely or error-free. For technical maintenance and/or security reasons, we may be obliged to partially or totally suspend access to the website temporarily and without notice. By accepting these Conditions of Use, users accept any such technical interruptions.
NEM reserves the right to update the website, particularly for technical or commercial reasons. When any such changes do not alter the conditions of use or, more generally, do not substantially and adversely affect the services that are provided, users may be informed of the changes made but their acceptance of such changes will not be required.
It is possible that the client may receive an item previously returned by another person. Nevertheless, intact items that have not been worn are only accepted, after a thorough check before being placed back in stock.
We do our best effort to provide all the information regarding our products, shipping and other information as accurately as possible on our website, social networks and other means of brand communication.
Occasional human errors, incidents or omissions may occur. If any of these affect the order made by the user, the user will be properly informed by e-mail and given the possibility to cancel or exchange the order. If the user cancels the order (within 24h), the amount paid will be fully reimbursed including any incurred shipping fees.
All information of any kind can be altered at any moment by NEM and shall take immediate effect once published.
The products offered for sale are those described and available on the website, within the limit of available product stock. Information is updated in real-time. Nevertheless, errors occurring during the update cannot hold the liability of NEM. Photographs from the catalogue are as similar as possible but could not ensure the perfect similarity with the product offered, especially for the colours of the products. These pictures do not have any contractual value.
Users must be 18 (eighteen) or more years of age to complete an order. Users under 18 years old may have authorisation from their representatives to complete an order.
By placing an order at NEM, you declare that you accept these Terms & Conditions which shall apply to all orders placed or to be placed at NEM for the sale and supply of any products.
All orders on our website are subject to Portuguese and European Law.
All the prices are given in Euros tax inclusive and are calculated as fairly as possible and explained on every product page.
We reserve the right to alter all product pricing without notice. The price on the product description does not include shipping costs.
Payments are secured by PayPal payment system, EuPago payment system and Stripe payment system. All products remain NEM property until full payment is made. The price applicable is that set at the date on which you place your order. Shipping costs and payment fees are recognised before confirming the purchase. All transfers conducted through NEM are handled and transacted through third party dedicated gateways to guarantee your protection. Card information is not stored and all card information is handled over SSL encryption. Please read the terms & conditions of the payment gateway chosen for the transaction as they are responsible for the transactions made.
Users who would like to include a VAT number, address or other data in the invoice, shall specify it in the notes section during the process of purchase.
It is also possible to request the inclusion of data to the invoice through email to firstname.lastname@example.org, provided such request is made within 24 hours after purchase.
Please note that local charges (sales tax, customs duty) may occur, depending on your region and local customs duties. These charges are at the customer's own expense.
RETURNS, EXCHANGE AND REFUNDS
In accordance with European law for online selling, the buyer has the right to withdrawal from an online transaction for any reason and will only have the return shipping fees at his charge. Legally, the buyer has up to 14 days to do this, counting from the delivery of the product. If the deadline expires on a Saturday a Sunday or a bank holiday or other non-working day, it is extended to the next working day. Beyond this, we reserve the right to refuse any returns, refunds or exchanges. Your enquiries must be sent to email@example.com.
The return or the exchange of the articles will only be accepted if the articles ordered are returned in perfect condition, not used or damaged. The products are returned at your own cost.
Important to notice that costume made article don't fall under this policy and won't be accepted for returns, exchanges or refunds.
It’s also important to notice that as we collect and reuse unknown fabrics, we are not able to inform the garments composition and care and wash liable instructions rather than hand wash. Therefore, any washing damages are not our liability and cannot be eligible within our return policy.
We exchange items if they don't fit, but unfortunately, we are not able to offer free returns or pre-paid labels. If you need to exchange it for the same item or have a return, send us an email at firstname.lastname@example.org mentioning the reason why you wish to exchange it, and we will proceed to review each request.
Note that as we work with unique fabrics in limited quantities we are not able to ensure that you will be able to exchange your product for the same you bought. Each request will be reviewed individually according to the available stock at the moment we receive the original item.
The item(s) can be exchanged within 14 days from the reception of the order. Once our team receives the items, we will ship the desired size/style once our team is able to produce the new piece given the workload at the time.

The exchange must be previously authorised by NEM team, who will provide you with an Exchange Reference.
Return Shipping Costs are the responsibility of the customer. In cases where a product is deemed defective NEM shall assume the entire cost of return shipping and/or exchange. Please ensure that all returned items are unaltered and include any original packaging, including all tags the item came with.
NEM cannot be held responsible for any loss or damage made by the courier chosen by the client. NEM advises the client to choose a courier with tracking services. Usually, the return of the product to NEM takes around 14 weekdays, but sometimes Portuguese customs need more information about the shipment in order to release it. The NEM product could be held by the border for up to a maximum of 10 weeks, and unfortunately, NEM is unable to offer a refund until the items are safely returned to our offices.

Refunds will be issued to the original method of payment. Where this is not possible, we will issue a credit note to use online. Shipping costs are non-refundable.
NEM has reasonable security levels. NEM will not be responsible for any losses suffered by the user and/or third-party individuals or entities because of delays, interruptions and suspensions of communication that origin in causes out of its control, namely scientific or failures caused by the communication network or communication services provided by third-party entities, by the computer system, modems, connection software or eventual virus.
All information filled in this service is presumed to be provided by the user. NEM declines any responsibility recurring from abusive or fraudulent use of the information.
NEM will not be responsible for any losses or damages caused by abusive use of the services, which are not directly attributable to wilful misconduct or gross negligence.

The user accepts that NEM cannot in any way be held responsible for any damage, including, but not limited to, damage caused by loss of profit, data, content or any other losses (even if previously warned by the User about the possibility of these damages) occurred by:
Impossibility of the User wearing the product.
The difficulty of replacing the service or product.

The customer who wishes to buy a product must:

Fulfil the identification sheet with the requested information and indicate or confirm his billing and delivery address.

All the data recorded is used as valid proof of the transaction.
DELIVERY AND DELIVERY TIME
After your order, you will receive a confirmation by email. NEM is working without any stock and every piece is made-to-order. The average delivery time is 2-3 weeks, depending on the numbers of orders and on the overload of work. All the orders are sent from Lisbon (the location of the workshop).
The orders are sent by CTT Correio Verde, even though we reserve the right to change the partner at any given moment as we see fit for each order. The average delivery time is 2/3 working days after shipping confirmation, for orders within Portugal; International orders may have a longer delivery period, depending on the destination country or location.
The user will receive a confirmation email once the package is with the delivery partner.
Note: users are liable for any costs related to “Goods & Customs” charged at the country of destination. Customs duties and taxes may apply in accordance with each country’s regulations. Portugal, a member of the European Union, is the country of origin for the shipment of all products ordered through our Website. NEM will not be held responsible for a delay in shipment caused by weather conditions, international customs issues or any other circumstances beyond the control of NEM. Once the orders are sent a change of delivery address will no longer be possible, so please make sure to fill out the correct address when checking out. If, for any reason, the customer refuses the delivery of the parcel or isn't available for receiving the parcel/doesn't pick up the parcel as requested by the courier, shipping costs and import duty fees related to the automatic return of the parcel to the sender will be charged to the customer. NEM is not responsible for parcels lost or damaged during shipping.
